The paper presents an exploratory attempt to analyse self‐reported leniency toward software piracy systematically, using an approach based on empirical factors, rather than ethical factors. The empirical factors studied were: social acceptance of software piracy; the cost of original software; urgency of the subject's need for software; availability of original software; knowledge of computer software copyright law; gender; monthly household income; and education level. It provides new insights to software companies and government officials who are developing programmes to promote the (...) concept of anti‐piracy among software consumers. In Hong Kong, transfer students encounter different challenges unfolding in their transition from community college to university study. However, limited research has been conducted to explore their discipline-specific challenges. To address this gap, in this study three engineering and science faculties were selected from which to collect data through 35 in-depth interviews with transfer students, followed by a thorough thematic analysis. With the concept of in-betweenness, three main themes were identified: “shifted the focus of study” academic excellence in community college; (...) future career in the university; and university life); “encountered challenges in the transition” non-matching program articulation; heavy study workload and its associated consequences; and non-specific administration arrangement and support from university); and “students’ voices to enhance learning experiences” modify the study duration; improve program articulation; improve social adjustment; and overseas exchange). The results of this study indicate the challenges faced by transfer students in their transition from community college to university and have implications for universities to design and implement appropriate strategies to prepare for the future. Abstract Objective Intuitive inquiry meditation is a unique form of Buddhist Zen/Chan practice in which individuals actively and intuitively utilize the cognitive functions to cultivate doubt and explore the concept of the self. This event-related potential (ERP) study aimed to investigate the neural correlates by which long-term practice of intuitive inquiry meditation induces flexibility in self-schema processing, highlighting the role of doubt and belief processes in this exploration. Methods Twenty experienced and eighteen beginner meditators in intuitive inquiry meditation were recruited (...) for this ERP study. The interactions of doubt and belief processes with concepts of the self and Buddha were investigated. A 128-channel electroencephalography (EEG) system was used to collect EEG data. The ERP data were processed and analyzed using EEGLAB. Results The data showed a double dissociation between beginners and experienced meditators (monks) in the concepts of the self and Buddha: intuitive inquiry meditation reduced the brain activity of beginners when viewing Buddha image but not when viewing a picture of themselves. However, in experienced meditators, intuitive inquiry meditation reduced brain activity when they viewed images of themselves but not when they viewed Buddha image. Further event-related spectral perturbation (ERSP) analysis revealed that experienced meditators had a greater theta spectral power and higher intertrial coherence (ITC), indicating that they could more flexibly modulate ongoing cognitive processes than beginner meditators. Conclusion Intuitive inquiry meditation could help beginner meditators detach from the concept of Buddha but not from that of the self. However, in experienced meditators, the opposite was true. ERSP analysis showed that only experienced meditators exhibited significant alterations in brain activity dynamics during intuitive inquiry meditation, which might enable these practitioners to become spontaneously detached from the concept of the self. These findings revealed the neural mechanism by which long-term practice of intuitive inquiry meditation can influence the doubting process and its effect on self-schema processing. (shrink)

This paper addresses methodological and metatheoretical aspects of the ongoing debate over the adaptive significance of Tibetan polyandry. Methodological contributions include a means of estimating relatedness of fraternal co-husbands given multigenerational polyandry, and use of Hamilton’s rule and a member-joiner model to specify how inclusive fitness gains of co-husbands may vary according to seniority, opportunity costs, and group size. These methods are applied to various data sets, particularly that of Crook and Crook (1988). The metatheoretical discussion pivots on the critique (...) by evolutionary psychologists of adaptationist accounts of polyandry. Contrary to this critique, I argue that valid adaptationist explanations of such practices do not necessitate cognitive mechanisms evolved specifically to produce polyandry, nor that there must have been exact equivalents of Tibetan agricultural estates and social institutions in human evolutionary history. Specific issues raised when one posits either kin selection or cultural evolution to explain the adaptive features of Tibetan polyandry are also discussed. (shrink)

Inference has long been a concern in epistemology, as an essential means by which we extend our knowledge and test our beliefs. Inference is also a key notion in influential psychological or philosophical accounts of mental capacities, from perception via utterance comprehension to problem-solving. Consciousness, on the other hand, has arguably been the defining interest of philosophy of mind over recent decades. Comparatively little attention, however, has been devoted to the significance of consciousness for the proper understanding of the nature (...) and role of inference. It is commonly suggested that inference may be either conscious or unconscious. Yet how unified are these various supposed instances of inference? Does either enjoy explanatory priority in relation to the other? In what ways or senses, can an inference be conscious, or fail to be conscious, and how does this matter? This book brings together original essays from established scholars and emerging theorists that illustrate how several current debates in epistemology, philosophy of psychology, and philosophy of mind can benefit from reflections on these and related questions about the significance of consciousness for inference. Our recent publication in Neuroethics re-constructed the perspectives of family caregivers of patients with disorders of consciousness on functional neurodiagnostics. Two papers criticized some of our methodological decisions and commented on some conclusions. In this commentary, we would like to further explain our methodological decisions. Despite the limitations of our findings, which we readily acknowledged, we continue to think they entail valid hypotheses that need further investigation. We conclude that some caregivers with high hopes for the recovery of their loved (...) ones with DOC will most likely not consider results of functional neuroimaging as guiding information for treatment decisions, despite efforts taken to deliver information to them. Caregivers of that type might argue that such test-results are not a reliable source of information for the judgement of whether their loved one is likely going to recover or not. We introduce the concept of epistemic beliefs to formulate this hypothesis and suggest that future qualitative studies in this area should be aware of such beliefs when investigating the effects of functional neurodiagnostics on knowledge communication and shared decision making for patients with DOC. Birth localities of spouses from two generations are examined, to assess the extent to which the observed patterns of marital mobility link the spatially separated and kin-structured sub-populations within the ‘shahrestan’ of Nowshahr. The results indicate localised marriages and short range movements from the village of birth in both generations. Temporal increase in the range of movement indicates the breaking down of isolation, thus providing greater possibilities for admixture and genetic homogeneity.

BackgroundFunctional neurodiagnostics could allow researchers and clinicians to distinguish more accurately between the unresponsive wakefulness syndrome and the minimally conscious state. It remains unclear how it informs surrogate decision-making.ObjectiveTo explore how the next of kin of patients with disorders of consciousness interpret the results of a functional neurodiagnostics measure and how/why their interpretations influence their attitudes towards medical decisions.Methods and SampleWe conducted problem-centered interviews with seven next of kin of patients with DOC who had undergone a functional HD-EEG examination at (...) a neurological rehabilitation center in Germany. The examination included an auditory oddball paradigm and a motor imagery task to detect hidden awareness. We analyzed the interview transcripts using structuring qualitative content analysis.ResultsRegardless of the diagnostic results, all participants were optimistic of the patients’ meaningful recovery. We hypothesize, that participants deal with the results of examinations according to their belief system. Thus, an unfavorable evaluation of the patient’s state had the potential to destabilize the participant’s belief system. To re-stabilize or to prevent the destabilization of their belief system, participants used different strategies. Participants accepted a “positive” HD-EEG result since it stabilized their belief system.ConclusionWe hypothesize, that a group of next of kin of patients with DOC deals with functional neurodiagnostics results on the basis of the result’s value and their high hope that the patient will recover meaningfully. A psychological mechanism seems to moderate the impact of functional neurodiagnostics on surrogate treatment decisions. (shrink)

We discuss cases where subjects seem to enjoy conscious experience when the relevant first-order perceptual representations are either missing or too weak to account for the experience. Though these cases are originally considered to be theoretical possibilities that may be problematical for the higher-order view of consciousness, careful considerations of actual empirical examples suggest that this strategy may backfire; these cases may cause more trouble for first-order theories instead. Specifically, these cases suggest that (I) recurrent feedback loops to V1 are (...) most likely not the neural correlate of first-order representations for conscious experience, (II) first-order views seem to have a problem accounting for the phenomenology in these cases, and either (III) a version of the ambitious higher-order approach is superior in that it is the simplest theory that can account for all results at face value, or (IV) a view where phenomenology is jointly determined by both first-order and higher-order states. In our view (III) and (IV) are both live options and the decision between them may ultimately be an empirical question that cannot yet be decided. (shrink)

A record of the words and teachings of Confucius, _The Analects_ is considered the most reliable expression of Confucian thought. However, the original meaning of Confucius's teachings have been filtered and interpreted by the commentaries of Confucianists of later ages, particularly the Neo-Confucianists of the Song dynasty, not altogether without distortion.In this monumental translation by Professor D. C. Lau, an attempt has been made to interpret the sayings as they stand. The corpus of the sayings is taken as an organic (...) whole and the final test of the interpretation rests on the internal consistency it exhibits. In other words, _The Analects_ is read in the light of _The Analects._This results in a truer understanding of Confucius' thought than the traditional interpretation and paves the way for a re-assessment of its importance in the history of Chinese thought and its relevance to the present day world.This volume also contains an introduction to the life and teachings of Confucius, and three appendices on the events in the life of Confucius, on his disciples, and on the composition of _The Analects._. I argue that it is a main theme of Davidson's theory of interpretation that interpretive charity implies the impossibility of massive disagreement. There is clear textual support for that. I then argue that from the first-person point of view of a full-blooded interpreter, the theme must be accepted; and that is precisely why Davidson accepts it. If massive disagreement between speaker and interpreter seems to us easy to imagine, it is only because the imagination involved is third-personal and not full-blooded.

It has been over a decade and half since Christof Koch and the late Francis Crick first advocated the now popular NCC project (Crick and Koch, 1990), in which one tries to find the neural correlate of consciousness (NCC) for perceptual processes. In his chapter in this book Chris Frith provides a splendid review of how neuroimaging has contributed greatly to this project. For the sake of contrast, this chapter takes a more critical stance on what we have actually learned. (...) Many authors have written on whether looking for the neural correlates would eventually lead to an explanatory theory of consciousness, while the proponents defend that focusing on correlates is a strategically sensible first step, given the complexity of the problem (Crick and Koch, 1998;Crick and Koch, 2003). My point here is not to argue whether studying the NCC is useful, but rather, to question whether we are really studying the NCC at all. I argue that in hoping to sidestep the difficult conceptual issues, we have sometimes also missed the phenomenon of perceptual consciousness itself. (shrink)

The development of commercial revenue streams allows traditional nonprofit organizations to increase financial certainty in response to the reduction of traditional funding sources and increased competition. In order to capture commercial revenue-generating opportunities, traditional nonprofit organizations need to deliberately transform themselves into social enterprises. Through the theoretical lens of institutional entrepreneurship, we explore the institutional work that supports this transformation by analyzing field interviews with 64 institutional entrepreneurs from UK-based social enterprises. We find that the route to incorporate commercial processes (...) and convert traditional nonprofit organizations into social enterprises requires six distinct kinds of institutional work at three different domains; these are—“engaging commercial revenue strategies”, “creating a professionalized organizational form”, and “legitimating a socio-commercial business model”. In elaborating on social entrepreneurship research and practice, we offer a comprehensive framework delineating the key practices contributing to the transformation from traditional nonprofit organizations to social enterprises. This extends our understanding of the ex-ante strategy of incorporating commercial processes within social organizations. Furthermore, the identification of these practices also offers an important tool for scholars in this field to examine the connection of each practice with different ethical concerns of social entrepreneurship in greater depth. While starkly different in genre, tone, and reception, the two films comprise a dialectical dyad that registers the historical transition from the utopian cultural effervescence of the early 1990s to the tragic foreclosure of imaginative horizons and the dystopian transformation of economic, political, and social landscapes in the new (...) millennium. In The Ice Harvest, the author argues, this is achieved through a strategic reactivation of film noir as a variant of the critical dystopia. (shrink)

How should we measure metacognitive sensitivity, i.e. the efficacy with which observers’ confidence ratings discriminate between their own correct and incorrect stimulus classifications? We argue that currently available methods are inadequate because they are influenced by factors such as response bias and type 1 sensitivity . Extending the signal detection theory approach of Galvin, Podd, Drga, and Whitmore , we propose a method of measuring type 2 sensitivity that is free from these confounds. We call our measure meta-d′, which reflects (...) how much information, in signal-to-noise units, is available for metacognition. Applying this novel method in a 2-interval forced choice visual task, we found that subjects’ metacognitive sensitivity was close to, but significantly below, optimality. We discuss the theoretical implications of these findings, as well as related computational issues of the method. We also provide free Matlab code for implementing the analysis. (shrink)

For critical legal scholars, the ongoing far-right assault upon the liberal status quo poses a distinct dilemma. On the one hand, the desire to condemn the far-right is overwhelming. On the other hand, such condemnations are susceptible to being appropriated as a validation of the very liberalism that critical theorists have long questioned. In seeking to transcend this dilemma, my focus is on the discourse of ‘white genocide’ — a commonplace belief amongst the far-right/white nationalists that ‘whites’, as a discrete (...) group, are facing demographic destruction as a result of deliberate policy choices. Such a belief has motivated acts of extreme violence. While libel to dismissal by experts on mainstream understandings of genocide, namely international criminal lawyers, I argue that this ‘white genocide’ discourse deserves careful scrutiny as a jurisprudential and socio-legal phenomenon that reveals key weaknesses in present modalities of liberal justification. Drawing upon an array of recent critical theories, I show how a liberalism unable to face its own decline enables the very far-right assertions it purports to oppose. Thus, given liberalism’s failure to act as a neutral arbiter, an alternative approach for those opposing the far-right is to develop a vision of politics and society that confront believers in ‘white genocide’ on a more substantive level. This, I argue, forces the far-right’s opponents to disavow liberal scepticism towards utopian transformation as well as the juridical understandings and institutions that allow this scepticism to durably persist. Contrary to Vaesen's argument that humans are unique with respect to nine cognitive capacities essential for tool use, we suggest that although such cognitive processes contribute to variation in tool use, it does not follow that these capacities arenecessaryfor tool use, nor that tool use shaped cognition per se, given the available data in cognitive neuroscience and behavioral biology.

One area of focus in contemporary debates on the Zhuangzi is whether the text endorses some kind of skepticism. For example, in chapter 2, Wang Ni expresses doubt toward "benevolence and rightness" and "the paths of right and wrong." He refuses to claim that there is something of which all things will agree to be right. However, the text repeatedly employs terms like "great knowledge" or "authentic knowledge", which hint at something endorsed or exalted by the text, if not right (...) in itself. Therefore, scholars have been trying to reconcile two sides of the Zhuangzi: the "guru" and the "skeptic."1 In the literature, scholars have refined their interpretation by differentiating skepticism into... Hong Kong is a territory of only 400 square miles in size, but with a large population of six million people. We have excellent medical facilities in both the public and private sector and the general health indices of the population are good, with low infant mortality rates and long life expectancies.

In four experiments involving 565 German speakers we tested several hypotheses about possible determinants of the side-effect effect, which consists of judging foreseen bad, but not good, side-effects of actions as intentionally produced. Experiment 1 failed to find intentionality ascriptions for bad side-effects for the majority of the participants in two different scenarios and obtained no consistent support for two hypothesized social-cognitive determinants of the see, the agent’s attitude and the mode of effect description. Experiment 2 replicated the see in (...) the original ceo scenario, but again found no evidence that the effect was influenced by the agent’s attitude towards the side-effect. The see was also not influenced by a manipulation of the moral quality of the agent’s primary goal. Experiment 3 investigated six additional scenarios used in previous studies and again obtained clear evidence for the see only in the ceo scenario. In addition, Experiment 3 demonstrated that judgments of both intent and intentionality strongly increased if the original side-effect was described as a means to the agent’s primary goal, or as an independently pursued goal. Taken together, the findings suggest that for German speakers, the see depends on the specifics of the scenario content and is difficult to obtain outside the original ceo scenario. Consistent with these conclusions, Experiment 4 documented parallel difficulties replicating the “means effect”, an analogue of the see on the level of means, but replicated the see in a scenario closely modeled after the original ceo scenario. ABSTRACTIn contrast to his contemporaries who take the heart–mind as the ruler of a person, Zhuangzi suggests that one’s action is guided by the spirit. Questions arise as one articulates the function of spirit and its relationship with the heart–mind. In this article, I articulate the relationship between heart–mind and spirit to show three points: first, spirit is a kind of qi 氣 that can be tied or run smoothly, or rather the mechanism triggered by the functioning of smooth qi. (...) This reading brings the skill passages together with the fasting of heart–mind passage. Second, the proceeding of spirit admits no fixed ways and is not confined to any particular organ or faculty, so it avoids the problem of self-assertion mentioned in Qiwulun. Third, the proceeding of spirit implies that one’s practice takes as many particularities of the context as possible into account, so the person has a higher chance to reduce conflict in interacting with things and other people and bring out their p.. This paper brings the intellectual tools of cognitive science to bear on resolving the “paradox of the active user” [Interfacing Thought: Cognitive Aspects of Human–Computer Interaction, Cambridge, MIT Press, MA, USA]—the persistent use of inefficient procedures in interactive tasks by experienced or even expert users when demonstrably more efficient procedures exist. The goal of this paper is to understand the roots of this paradox by finding regularities in these inefficient procedures. We examine three very different data sets. For each data (...) set, we first satisfy ourselves that the preferred procedures used by some subjects are indeed less efficient than the recommended procedures. We then amass evidence, for each set, and conclude that when a preferred procedure is used instead of a more efficient, recommended procedure, the preferred procedure tends to have two major characteristics: (1) the preferred procedure is a well‐practiced, generic procedure that is applicable either within the same task environment in different contexts or across different task environments, and (2) the preferred procedure is composed of interactive components that bring fast, incremental feedback on the external problem states. The support amassed for these characteristics leads to a new understanding of the paradox. In interactive tasks, people are biased towards the use of general procedures that start with interactive actions. These actions require much less cognitive effort as each action results in an immediate change to the external display that, in turn, cues the next action. Unfortunately for the users, the bias to use interactive unit tasks leads to a path that requires more effort in the long run. Our data suggest that interactive behavior is composed of a series of distributed choices; that is, people seldom make a once‐and‐for‐all decision on procedures. This series of biased selection of interactive unit tasks often leads to a stable suboptimal level of performance. (shrink)

The Zhuangzi is a collection of ancient Chinese anecdotes and fables that serves as a foundational Daoist text. The style in which it is written is significant because it obscures rather than reveals the text’s philosophic positions. If the text cannot be translated into plain language while preserving its content, as the Mozi or the Mencius generally can be, then the writing style is not merely rhetorical. The style is itself indispensable to the content. In this study, I analyse a (...) linguistic device mentioned in the Zhuangzi and use it to reflect the text’s writing style—namely, “goblet words”. I argue that various logical forms of goblet words defy the act of fixing a definite answer in any conceptual distinction or disputation. The forms, which include dilemmatic questions, oxymora and double denial, all serve to preserve indeterminacy. Reading goblet words may affect readers by making them more open-minded towards distinctions. However, readers cannot ascertain that the text’s authors produced this effect intentionally. Therefore, the text may cause readers to be open-minded while the authors remain free of commitment. (shrink)

Abstract:This paper examines the idea of xing 性 in Guo Xiang's Commentary on the Zhuangzi in order to show the distinctiveness of Guo's thought. I argue that, for Guo, xing is individualized and subject to no external standard, not even to the "normal" condition proposed by the primitivists in the Zhuangzi. Regarding the debate about xing's changeability, I argue that one's xing can change over time, even by learning, although this change is constrained within certain boundaries. The individualization of xing (...) and the need of holding to one's boundaries serve to explain the emergence of social norms, which can and should be established in a way that respects different xing. This dynamic between individuality and social organization contributes to our thinking about fundamental tensions in human life. (shrink)

The attitude toward li 利 is often identified as a key difference between the Mencius 孟子 and the Mozi 墨子. A common view is that for the Mencius, rightness (yi 義) and li are incompatible; but for the Mozi they are not necessarily so. In this paper I argue that the Mencius and the Mozi are in broad agreement on the issue of li, and their attitudes toward li are not as different as may seem at first glance. If we (...) take a finer-grained understanding of li in two ways, namely the self-regarding li and the other-regarding li, then both the Mencius and the Mozi would criticize the former but encourage the latter. The term li in the Mencius has a range of meanings, and it is not clear whether the Mencius actually opposes all li-pursuing activities. Mencius would agree with Mozi that, at least in some cases, one is obligated to seek li for others. Furthermore, despite their criticism of self-regarding li, both Mencius and Mozi allow that in some cases it is morally permissible to act from the motive of self-regarding li, as long as this motive coexists with the motive of rightness. That is, self-regarding li and rightness are not always mutually exclusive, even for Mencius, who seems to be more critical of li. (shrink)
